The Judicial Manual of Environmental Law for Magistrates of Madagascar serves as a tool for the ENMG in the context of integrating environmental law into the training curricula of magistrates and future magistrates by helping them to know which rule of law is applicable in order to judge and deal objectively with the environmental cases that are submitted to them, but also to better understand the scope and limits of these legal provisions.
Additionally, the National School of Magistrates and Registrars of Madagascar (ENMG) has published the Judicial Manual of Environmental Law for the use of magistrates in Madagascar with the support of the Institut de la Francophonie pour le Développement Durable (IFDD). In this manual, the second part is devoted to the legal framework of environmental sectors, including biosafety. In this context, the manual deals with the legal aspects of biosafety in Madagascar with the following highlights: presentation of the national biosafety policy, sectoral legal framework concerned with biosafety as well as the specific legal framework for biosafety.
What challenges/obstacles have been encountered in the implementation of this Resolution and how were they overcome :
The publication of the Judicial Manual of Environmental Law for the use of magistrates in Madagascar provides a consolidated version of the existing legislation while highlighting the challenges and gaps in Malagasy biosafety legislation. This activity thus contributes to strengthening current legislation to better protect against invasive alien species (IAS) in Madagascar.
The manual could serve as a reference tool for the IUCN World Commission on Environmental Law in implementing recommendations i.a. of the resolution.
